Last year, a class-action lawsuit was filed against Nintendo by Chimicles Schwartz Kriner & Donaldson-Smith (CSK&D) on behalf of all of the people who have suffered through “Joy-Con drift” with their Nintendo Switch or (per an update to the suit) Nintendo Switch Lite. The phenomenon of Joy-Con drift is of course when the control stick on a Joy-Con controller registers input when no such input has actually been made, resulting in, for example, annoying situations where your character starts walking for no reason. Now, an update on the proceedings has come from a CSK&D email shared by a Reddit user, of all things.
It was known this past March that the Joy-Con drift lawsuit had shifted into arbitration, but CSK&D is now soliciting those affected by drift to aid the firm in making its case. The shared email is asking people to “submit a short (90 seconds or less) video to us describing your experience with the Joy-Con drift on your controllers” by Oct. 16. These video clips will be assembled into a montage in court to refute “Nintendo’s arguments about how this isn’t a real problem or hasn’t caused anyone any inconvenience.”
To be clear, this is how the law firm suing Nintendo describes Nintendo’s position on the subject, but the firm has no reason to misrepresent Nintendo’s position.
If you want to submit a video detailing your struggles with Nintendo Switch Joy-Con drift, first take a look at what the firm is looking for, and then email your clip to [email protected]. CSK&D likely wasn’t expecting the added attention of a Reddit post though, and the firm probably will not be hurting for examples and anecdotes of drift in action.
